There is no requirement that the attorney who drafted the Will be the attorney who probates the Will. The executor is free to hire the attorney of his or her choice.

The executor’s job is to gather the assets, pay the required debts, and distribute the remaining assets to the beneficiaries as named in the will.

When the deceased has not left a will, the estate can be probated as a dependant administration. This type of administration can be expensive and time consuming because prior to taking any action the administrator must seek court permission. There are options to having a dependant administration such as Muniment of Title, Small Estate Administrations, and seeking permission to convert the administration to an Independent Administration.
